Canada

Well known for its cold weather and love of hockey, Canada has recently been recognized as the country responsible for not adding asbestos to the international hazardous list. Canada’s asbestos mining efforts started around 1850 when chrysotile asbestos deposits were discovered in Thetford. By 1876, approximately 50 tons of asbestos were being mined in Quebec. By the 1950s, the annual mining haul was more than 900,000 tons.
In early 2011, the Jeffrey Mine in Asbestos, Quebec, received scrutiny after the Canadian government proposed a $58 million grant to reopen the mine. Because private investors failed to raise $25 million by the July 1, 2011 deadline to purchase to mine, the grant from the Quebec government has been delayed for an unknown amount of time. India

The second-most populous country with more than 1.2 billion people, India’s extensive use of asbestos will likely have a significant impact on the future health of the country’s population. Experts predict a pattern similar to what developed in the United States over the past 50 years: a dramatic rise in the number of cases of asbestos-related diseases.
India no longer mines asbestos, but it is the top importer of Canadian asbestos. About 20 years ago, India handled 500,000 tons of asbestos cement roofing. Today, that number is closer to four million tons.
India in 2011 changed its long-held stance and voted to add asbestos to the hazardous list at the 2011 Rotterdam Convention. The Ban Asbestos Network of India (BANI) is a group of scientists, doctors, public health researchers, trade unions, activists and civil society groups that condemn the use of asbestos and push for an immediate ban on asbestos. BANI has been successful in drawing attention to the hazards and toxic effects of asbestos exposure.

United Kingdom

The United Kingdom in 1931 introduced the Asbestos Industry Regulations. At the time, the regulations determined only the “safe” level of exposure. In 1960, the legal exposure limit was increased, placing workers at a higher risk of contracting mesothelioma and other asbestos-related diseases. By 1968, the standards for exposure levels were lowered to reduce the risk of contracting disease.
England, though, is paying for years of higher level exposure. In 2008, the last year for which figures are available, 2,249 people in the UK died of mesothelioma. The UK has prohibited the trade, application and supply of crocidolite and amosite asbestos since the 1980s. Chrysotile asbestos was prohibited in 1999.

Australia is another country with a sweeping history of asbestos use, although its heavy-use years are long gone. Its peak year was 1975 when the country used about 70,000 tons. But years of overuse impacted the long-term health of Australian citizens: There were 551 deaths related to mesothelioma cancer documented in 2007.
Perhaps no place in the world can show the toxicity of asbestos better than the town of Wittenoom in Western Australia. Mining began there in 1939, and eventually the predominant asbestos was crocidolite, replacing the less-toxic chrysotile asbestos. Multiple health reports indicate that exposure to crocidolite asbestos leads to an increase in the development of asbestos-related diseases.
Because of Wittenoom’s long history of mining and the exposures that occurred as a result of that history, Western Australia has the highest rate of mesothelioma and asbestos-related cancers in the world. The town was shut down in 1966 because of low profits and rising concerns for asbestos-related diseases.

Russia

Russia, which is the largest country in the world in terms of land mass, also leads the planet in asbestos production. In 2000, asbestos productions reached approximately 700,000 tons, much more than Canada and China. By the year 2008, mining produced more than one million tons of asbestos.
Russia’s high production numbers stem from the city Asbest, located about 900 miles northeast of Moscow. Once known as “the dying city” because of its high rates of mesothelioma and other asbestos-related diseases, Asbest is home to a mine that measures seven miles long, one-and-a-half-miles wide and more than 1,000 feet deep.
About 500,000 tons of asbestos is gathered from the mine each year.
Unlike Canada, Russia has remained a large user of asbestos. It is the world’s third-largest consumer, trailing only China and India. Russia has widely used asbestos in roofing materials, automobile brakes and insulation. About 3,000 asbestos-containing products have been labeled as safe by the Chief Sanitary Officer of Russia.
Annual asbestos-related deaths were 10,400 in 2005. With little opposition towards the use of asbestos, Russia will likely continue to use and export this toxic substance.

South Africa

South Africa began mining asbestos around 1883 after a crocidolite asbestos mine was established in the Northern Cape region in Koegas. The country developed into a major producer of crocidolite asbestos, supplying Australia and the United Kingdom with the heat-resistant mineral for many years during the 20th century.
South Africa’s mining of asbestos peaked in 1977 at 380,000 tons, making it the third-largest supplier in the world. But within a decade, the Northern Cape mines were closed because of the medical risks involved and a growing concern of asbestos-related litigation.
Because the health effects of asbestos exposure were largely hidden by the asbestos mining industry, there was little public awareness of mesothelioma and other asbestos-related diseases until the late 1970s. Following the lead of the Northern Cape mines, several other asbestos mines in South Africa also closed, and residents of Prieska formed Concerned People Against Asbestos (CPAA), which focuses on improving access to compensation for citizens battling asbestos-related diseases.

China

China is one of the world’s largest producers of asbestos. The country mined more than 450,000 tons in 2000, a total that placed it behind only Russia in asbestos production. Since, Chinese production has fallen. Its mining total fell to about 280,000 tons in 2008.
Unlike Canada, Chinese manufacturers and builders consume large amounts of asbestos, using it for roofing materials, walls, brake pads, gaskets and cloth. Jukka Takala, director of the European Agency for Safety and Health at Work, believes the annual Chinese death toll from mesothelioma and other asbestos-related diseases could reach as high as 15,000 by 2035.
At the 2009 Asian Asbestos Conference, a ‘Hong Kong Declaration Towards a Complete Ban on all forms of Asbestos’ and asbestos processing was recommended. The declaration asked for asbestos use to be phased out and recognized the need of assistance for those suffering from asbestos-related diseases.

Brazil

Brazil is the world's third-largest producer of asbestos. It is also the third-largest exporter, shipping primarily to Asia, Mexico and Colombia. Although exporting asbestos brings in a significant amount of revenue for exporters, Brazil keeps a large share of the mineral within its borders. The country used 94,000 tons as recently as 2007, ranking it No. 5 among the world's asbestos consumers.
There are 11 Brazilian companies that continue to mine asbestos and produce asbestos-containing products. The production generates about $1.3 billion annually for the country's economy. While these companies employ nearly 3,500 people, the asbestos industry says mining the toxic substance creates about 200,000 jobs.
Estimates predict the rate of mesothelioma and asbestos-related deaths will continue rising in Brazil's future. Dr. Ubiratan de Paula Santos, a pulmonologist at the University of São Paulo Medical School, treats about 20 mesothelioma cases a year, and he says that number is slowly climbing. The majority of his patients are current and former asbestos plant workers.

Kazakhstan

Kazakhstan is one of the world's largest producers of asbestos, mining 230,000 tons of it in 2009. While Kazakhstan exports most of the mineral it mines, it does consume some. Houses, apartment buildings, hospitals, schools, commercial buildings, brakes and other products are manufactured with asbestos products. Recent developments, however, may turn this trend.
In 2009, 75 participants of a conference on the use of chrysotile asbestos and its health effects recommended the Kazakh government support a national program to eliminate asbestos-related diseases. Since the conference, the first of its kind in Kazakhstan, other seminars on the side effects of asbestos have pushed the notion that Kazakh citizens are ill-informed about asbestos-containing materials. Those leading the seminars say there is now stronger public participation in monitoring existing asbestos regulations.

Who Gets Mesothelioma?

People believed to be in the high risk category for getting mesothelioma are those who were exposed to asbestos on a regular basis (six months or more) while on the job. Among the list of occupations closely linked to mesothelioma and other asbestos-related diseases are:

"What is mesothelioma?" That's a question oncologists often hear immediately upon delivering a diagnosis of this disease. The short answer is, mesothelioma is a cancer that is directly traceable to repeated or long-term exposure to asbestos. Usually, though, a longer explanation is needed.
The disease gets its name because cancerous tumors form in the mesothelium – the lining – of an internal organ. In the case of mesothelioma, the tumors form in the lining of the lung, the lining of the abdomen, the lining of heart or the lining of a testicle.

All four types of the cancer are aggressive. Cancer cells usually spread rapidly, and the life expectancy of someone with the disease is between eight and 18 months. Through clinical trials and experimental therapies, specialists seek more effective treatments to extend life expectancy and, they hope, to find a cure.

A primary reason the survival rates of all types of this disease are so low is that most diagnoses are made in stage III or stage IV – a direct result of mesothelioma having mild, often undetectable, symptoms in its early stages of development.

When do Mesothelioma Symptoms Emerge?

Typically, mesothelioma patients notice the first signs of their disease 30 to 50 years after they were first exposed to asbestos. This latency period is not significantly different between varying subtypes of mesothelioma, but some studies have noted a shorter latency period for peritoneal mesothelioma (20 to 30 years) than pleural mesothelioma. However, in one 2011 study of 191 malignant mesothelioma cases, women were found to have a longer latency period than men:


A larger retrospective study of 1,690 mesothelioma patients found the median latency period to be 32 years, while an even larger 2006 Italian study of 5,173 mesothelioma patients reported an average latency of 43.6 years. Once signs of mesothelioma finally emerge, they are typically mild. Many patients may not pay attention to them when they first arise, only seeking a medical consultation when symptoms intensify. Additionally, a high percentage of mesothelioma patients have other respiratory diseases and the onset of mesothelioma is often misinterpreted as a progression of an existing condition such as COPD.

Because of the long latency period, symptoms are not always addressed right away. One study found that the interval between the first presentation of symptoms and referral to appropriate treatment was as high as 39 months.

What Symptoms Indicate Metastatic Spread?

Not all mesothelioma symptoms are confined to the site where the cancer originates. The symptoms that are most closely related to local invasion include:
Localized spread to the lymph nodes is most common and occurs in approximately 44% percent of cases.
  • Dysphagia (coughing/spitting up blood)
  • Horner's syndrome (or other neurological syndromes)
  • Laryngeal nerve palsy
  • Nerve involvement of the arm
Paraplegia can occur if the cancer spreads to the spinal canal. Metastatic mesothelioma can also obstruct the superior vena cava. Hypoglycemia has also been reported as a clinical feature of invasive mesothelioma, yet this primarily occurs in patients with rare localized fibrous mesothelioma. Clubbing of the fingers and hypertrophic pulmonary osteoarthropathy (HPOA) are even rarer but occur in a handful of malignant mesothelioma cases, primarily when asbestosis is also present.

What are the Symptoms for Other Types of Mesothelioma?

Peritoneal mesothelioma:

Abdominal pain is the first symptom that most peritoneal mesothelioma patients exhibit. This is commonly followed by abdominal enlargement and tenderness. Ascites, fluid buildups between the peritoneum and the abdominal organs, are very common, but they often develop later in the progression of the illness. In a study of 13 peritoneal mesothelioma patients, 77 percent of participants developed ascites.


Peritoneal mesothelioma is also associated with a loss of appetite that often results in weight loss, abdominal distention/pelvic mass and abdominal hernias. In one study, 69 percent of peritoneal mesothelioma patients lost weight. Patients may also note bowel obstruction very late in the progression of peritoneal mesothelioma. Additionally, one Australian study found that 10 percent of all diffuse malignant peritoneal mesothelioma patients experienced short, mild seizures.

Pericardial mesothelioma:

The few available case reports on pericardial mesothelioma name difficulty breathing and chest pain as the symptoms of this subtype. These symptoms are the result of the pericardium thickening.

Mesothelioma is a rare cancer that is caused almost exclusively by exposure to asbestos. It can affect the thin, protective membrane surrounding the lungs, heart or abdominal cavity. An estimated 3,000 cases annually are diagnosed in the United States, and the majority of those are traced to an occupational exposure.


Although the use of asbestos has been reduced dramatically in recent decades, the incidence of mesothelioma has remained steady. It can take anywhere from 20 to 50 years after exposure to asbestos before obvious symptoms appear and a definitive diagnosis is made. While there still is no cure - and the prognosis is typically poor - significant progress has been made in recent years regarding treatment options and various alternative therapies.

Trouble for personal injury law firms means trouble for claimants.

Nearly a fifth of the law firms in the north-west of England that specialist in personal injury work are considering closing down, according to a survey conducted last week.

The poll was carried out by O'Connors, a Liverpool law firm that provides business advice to other law firms. Whether its findings are an accurate prediction of what is likely to happen across England and Wales is less important than the broader point it makes: personal injury work is under threat and weaker firms are going to the wall. A new campaign group claims that as many as 100,000 jobs will be lost over the next year. Although predictions such as this have been reported in the specialist legal
press for some months now, they tend not to make much of an impact in the mainstream media – at least until a large firm is closed down by the regulator, as happened earlier this month.

The reasons for public indifference are not hard to see. At a time when businesses are finding it hard to survive, there is little public sympathy for solicitors – unless you happen to be an employee of a law firm or the victim of catastrophic medical negligence. And, at back of people's minds, there is an impression that personal-injury lawyers are ambulance chasers – dodgy geezers who make their money from easily fabricated claims of whiplash injury arising from motoring shunts.

We know, of course, that some claimants are dishonest. It must be very tempting to exaggerate one's injuries when there is money to be made, especially when it is uneconomic for insurers to challenge every claimant's account of an accident. And no doubt there are some lawyers, struggling to stay in business, who don't ask too many questions when an unscrupulous claimant walks through the door.

But, at least until recently, many of the ambulance-chasers and the people who advertise for claimants on day-time television have been claims farmers who sell potential clients on to law firms. I use the word "sell" because law firms pay a referral fee for each case they buy. The going rate is said to be around £700. And payment of these referral fees will be banned under legislation that takes effect from the beginning of next month.

There may be ways of getting round this ban. The most obvious is for law firms themselves to advertise for clients, pooling resources as appropriate. A more sophisticated way of doing this would be for the law firm to buy an existing claims management company, a move that's possible now that solicitors can set up what are called alternative business structures. And perhaps money will change hands in more shadowy ways.

Whichever way it works, though, lawyers who wish to carry on doing personal injury work will need to spend money on marketing their services. And it's money they are not going to get back from anybody but their clients. Claimants take it for granted that insurers will pay all the legal costs involved in a successful claim. In future, it's more likely that a proportion of the damages will be deducted to pay the claimant's own lawyers.

To understand this, you have to know about the RTA portal, as it's currently called. RTA stands for road traffic accident and the portal is simply a computer system enabling claimants' lawyers to send standardised accident claims direct to defendants and their insurers for settlement. It was set up nearly three years ago, not without the teething troubles that seem inevitable with new computer systems, and it now covers most personal injury claims arising from motoring accidents – those worth between £1,000 and £10,000.

The system is run under guidelines from the Ministry of Justice, which currently permits claimants' lawyers to charge insurers fixed costs of £1,200. Last month, however, justice secretary, Chris Grayling, announced that these fees would be cut to £500 from the end of April. A subsequent legal challenge to the cuts was unsuccessful. In addition, the portal will be extended to cover claims worth between £10,000 and £25,000. Costs for these claims will be fixed at £800. And, from the summer, the scheme will be extended to cover claims for employer and public liability worth up to £25,000. It will then be known as the claims portal.

The government's justification for cutting lawyers' fees by more than half is that solicitors will saving as much as £700 per case in referral fees. But lawyers complain that they will still have to pay marketing costs. Ominously, David Edmonds, the industry's super-regulator, told MPs this week that the ban on referral fees might have unintended consequences. Edmonds, who chairs the Legal Services Board, has long argued that there is no evidence of consumer detriment from referral fees and so no justification for a ban.

Quite apart from the question of whether referral fees encourage people to bring unwarranted claims, the insurance industry argues that reducing the costs it pays to claimants' lawyers will reduce the size of insurance premiums – though it cannot say by how much. Lawyers claim that the move will simply increase the size of insurers' profits.

No doubt the truth, as usual, lies somewhere in between. Insurers will probably receive fewer spurious claims. Perhaps premiums will not increase as quickly as they might have done. But people who suffer serious, debilitating accidents through no fault of their own will find it harder to claim compensation. And when that compensation does come, it will be less than the claimants deserve.
